1. Acceptance of Terms

By creating an account or using PitchMe (“Service”), operated by PitchMe, Inc. (“Company,” “we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, you may not use the Service. These Terms constitute a legally binding agreement between you and PitchMe.

2. Eligibility

You must be at least 18 years old to use PitchMe. By using the Service, you represent that you are 18 or older. Students must be currently enrolled in or recently graduated from a college or university. Recruiters must represent a legitimate employer or staffing organization.

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration and to keep your profile information updated. You may not share your account with others or create multiple accounts.

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or are inactive for an extended period.

4. Acceptable Use

You agree not to:

  • Post false, misleading, or deceptive content in your profile, pitch video, or messages
  • Impersonate any person or entity
  • Upload content that is illegal, harmful, defamatory, or infringes third-party rights
  • Use the Service to spam, harass, or discriminate against others
  • Attempt to gain unauthorized access to any part of the Service or its systems
  • Scrape, crawl, or use automated means to access the Service without permission
  • Use the platform for any purpose other than legitimate career networking and hiring
  • Sell or transfer your account to any third party

5. Content and Intellectual Property

5.1 Your Content

You retain ownership of the content you upload to PitchMe, including your pitch videos, profile information, and messages (“Your Content”). By submitting Your Content, you grant PitchMe a worldwide, non-exclusive, royalty-free license to use, reproduce, store, and display Your Content for the purpose of operating and improving the Service. This includes using your pitch video transcript to generate AI coaching and embeddings for job matching.

5.2 PitchMe Content

The Service, including its design, software, AI models, and content created by PitchMe, is protected by copyright, trademark, and other laws. You may not copy, modify, distribute, or create derivative works from PitchMe's proprietary content without our written permission.

6. AI Features

PitchMe uses AI to provide pitch coaching feedback, career suggestions, job matching, and an AI Advisor chatbot. AI-generated content is provided for informational purposes only and should not be relied upon as professional career, legal, or financial advice. AI outputs may contain errors or inaccuracies. We are not responsible for decisions made based on AI-generated recommendations.

7. Recruiter Responsibilities

Recruiters using PitchMe agree to comply with all applicable employment laws, including anti-discrimination laws (e.g., Title VII, ADA, ADEA). You may not use student profiles, videos, or data to discriminate based on race, color, religion, sex, national origin, age, disability, or any other protected characteristic. PitchMe reserves the right to suspend recruiter accounts that violate these obligations.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES. WE DO NOT GUARANTEE EMPLOYMENT OUTCOMES OR JOB PLACEMENT RESULTS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PITCHME SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR ANY CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF $100 OR THE AMOUNTS PAID BY YOU TO PITCHME IN THE PAST 12 MONTHS.

10. Indemnification

You agree to indemnify and hold harmless PitchMe, its officers, directors, employees, and agents from any claims, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Service, Your Content, or your violation of these Terms.

11. Termination

You may close your account at any time from the Settings page. We may suspend or terminate your account for violations of these Terms, with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will remain in effect.

12. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved in the federal or state courts located in Delaware, and you consent to personal jurisdiction in those courts.

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by email or by posting a notice on the Service. Your continued use of the Service after the effective date of any changes constitutes acceptance of the revised Terms.
